1. Premisis 

 

  1. With the present Terms and conditions for online purchase (GCOS) Gateseven s.r.l Fiscal Code and VAT number 04311420618, head office in Caserta (81100 – CE), Via Salvemini, 17 (“Gateseven“), runs the commercial relations with browsers and costumers, as defined below, pursuant to electronic negotiation.

 

2. Definitions 

 

  1. To the expression conventionally indicated with capital letter ( both singular and plural) it has to be given the following meaning:

 

  • General conditions of sale (ECGV) : contractual conditions in which Gateseven runs the commercial relations with the costumers, as defined below, by virtue of electronic negotiation.
  • Costumer: the one who concludes a contract with Gateseven. Pursuant to the ” Italian Consumer Code” (Legislative Decree n.206/2005), the costumer is the physical person or juridical who operates for purpose which are outside the business or professional activity, namely the intermediary (The Trader ). When in the following GCOS refers to the Costumer, both Customer  and Trader are included; otherwise, it will be made reference to the person concerned ( for example, in the right of the withdrawal clause, excersisable only by the consumer.
  •  Surfer: any person browsing the Website, who is committed to respecting the rules as far as he is concerned, even if he’s not a Costumer.
  • Privacy: discipline concerning privacy, that Gateseven posts on the Website, due to  trattamento dei dati personali of the Surfer and the Costumer.
  • Data:  personal data of the Surfer and the Costumer, provided in accordance with Privacy, for example, filling the form for the registration to the website;
  • Product: object of the single Transaction ( hats and accessories). All information related to  Products collected in the relative schedule won’t meant to be binding to Gateseven, if not agreed in the modalities required to GCOS. It should be noted that, the schedule contains relevant data and info of the Product and in case some particular exigences it is responsibility of the costumer to ask to Gateseven for more info about the Product;  
  • ; of a platform of electronic commerce, addressed to the Surfers for the purchase of Gateseven’s Products, Thanks to the Service, the Surfers can consult the products’ catalogue and to purchase the Products online. It is understood that the Service ownership is exclusively lead back to Gateseven, who runs autonomously and at its sole discretion, except the application of the GCOS
  • Parts: Gateseven and the Costumer;
  • Contract : agreement for the purchase of one or more Products concluded electronically between the Parties pursuant to the GCOS . The contract is considered concluded in the place where Gateseven has its registered office;

 

3.  Access to the Website.

 

  1. The Website hosts a web platform designed to provide a Service, through which the Surfers can buy Gateseven’s Products.
  2.  The access to the Website, the consultation of information related to the Products that are on the Website and the registration to the Website are free.
  3. In virtue of the fulfillment of the obligations provided by the Contacts, Gateseven do not guarantee the continuous and interrupted access to the Website, that could be conditioned by different and  various independent factors  and by the Service.
  4. The access to the Website ( including the reserved area for the online purchase) can be suspended or interrupted by Gateseven’s own discretion, for example, for technical reasons of any kind, for business decisions, for the occurrence of unforeseeable circumstances or force majeure. For the violation of the Surfer’s obligations here exposed, without him having anything to expect from Gateseven.
  5. Gateseven is allowed anytime to make changes and to modify the access mode of the Service, even if these modifications provide a variation of contents of the Service.

 

4. Referral 

 

  1. The Contract of purchase concluded between the Parties are ruled by the I available on the Website on the section Condizioni Generali.
  2.  Privacy police is covered in the page Website Privacy. Willing to assure guarantee concerned privacy to the interested parties, and in particular, to Surfers and Costumers, Gateseven has decided to inspire its privacy policy to the one established by the European Union, even in case it results to be not applicable to the case.

 

5. Surfer’s Obligations 

 

  1. The Surfer undertakes to access to the Website and to make use of the Service in full respect of the imperative rules of civil, penal and administrative nature (local, regional, national, international and communitarian). In particular, but not exclusively, in relation to the discipline (i) of the subject of personal data (ii), in relation to copyright and industrial property, (iii) aimed at combat the cyber-crimes.
  2. Fermo quanto sopra, in via non limitativa, il Navigatore si impegna: (i) a non usare il Sito per scopi illegali, illeciti ovvero contrari all’ordine pubblico, al buon costume e alla morale; (ii) a non usare il Sito per trasmettere o diffondere in alcun modo materiale abusivo rispetto allo Scopo e al Servizio offerto da Gateseven, illegittimo, illecito, Notwithstanding the above, in via not limited, the Surfer undertakes to : (i) not using the Website for unlawful purposes, illegal, i.e. contrary to public policy, decency and morality; (ii) not using the Website to transmit or to spread in any way abusive material compared to the Purpose and to the Service provided by Gateseven, illegitimate, vulgar,illicit, pornographic, racist and/or obscene material and/or messages that encourage third person to have an unlawful conduct and/or criminal conduct liable to criminal, civil or administrative liability; (iv) to not send commercial and/or advertising messages, i.e. to not put in place spam activity, or any other form of illicit communication and/or contrary to the rules of netiquette; (v) to not infect the web or the system that allows the provision of the Service with virus, malware or other harmful programs which can interfere, damage, intercept, eliminate data or personal information, to not use any kind of peer to peer programs with the same intentions; (vi) to not do actions that can give place to unreasonable burdens or to create an excessive technological load  on the system of the Website.

 

6. Link and malware

 

  1.  Even checking periodically the content of the Website’s pages linked by the Website or accessible by advertising banners (and/or other advertising spaces) in the Website, Gateseven cannot undertake any responsibility in relation to this contents.
  2. Even though the periodical check of the Website, Gateseven cannot guarantee that it is immune to virus or other programs potentially harmful.

7. Industrial and Intellectual Property. 

 

  1. The Surfer acknowledges that the brand and the distinctive signs, the contents, the information, the programs, the layouts, the texts, the images, the photos ( including, in particular, the one of the Products wore by the models) the videos, and the data used by Gateseven, as well as any and every technical inventive and creative solution, designed or created by Gateseven on the Website, are covered by exclusivity and owned by Gateseven,unless otherwise specified in writing, anyway agreed with the right-holders.
  2. It is specifically forbidden to the Surfers any improper use of the Website not connected to the purpose of Gateseven and averse provided how much from the 8A section, including, for example, the reproduction, the purchase, the modify, the distribution, the transmission and the republication even partial of the information, programs, layouts, texts, photos, and the data available on the site and of the technical inventive and creative solutions adopted.
